LEGAL TIPS FOR WHITTIER STUDENTS
Laws in general are strict. If you
violate the law, count on getting caught. If you are arrested, the
College Legal Clinic may be able to assist you. However, you will
still have to sit in jail until you can post a bond. If you are
convicted, you will suffer the fines and a possible jail term. The
following information is to remind you of the law and it's
penalties.
The following is a guide to
partying legally and courteously:
Show respect and consideration:
Let your neighbors know in advance. They will probably be the
ones most affected by the noise, and an advanced notice will allow
them to make necessary arrangements. Make sure that they have your
name and phone number so they can call you regarding complaints.
Notify Campus Safety: Let
Campus Safety know the date and time of the party. They will
appreciate having the name and phone number of someone to contact
in the event that complaints start coming in.
The door monitor: It's a good
idea to have a door monitor and a designated driver. The door
monitor can help keep unwanted people out and help prevent drunk
guests from leaving and driving. The door monitor can also help
keep the guests inside, thus preventing the noise from disturbing
your neighbors.
Throw a theme party: Theme
parties can be a lot of fun, if you have a good theme. The
theme can be anything. They can be based on movies, seasons,
colors, or something totally off the wall. A good theme will make
the party more interesting and make your party stand out from all
of the others, where people just sit around and drink. Don't
forget to have a little food for your guests.
Limit the size of the party:
The best way to eliminate a parking problem is to limit the size
of your party to the space available. This includes parking and
housing space.
The following are some local laws
to be aware of while partying:
* The legal drinking age in
California is 21 years, and is strictly enforced. False
representation of your license and/or age is a misdemeanor.
Falsifying your driver license is a felony. You could face stiff
fines and a possible jail sentence for violating these laws.
* You cannot sell alcohol--
only a licensed establishment can distribute and sell alcohol.
This means that: You cannot sell cups or popcorn. You cannot
collect for alcohol at the party or charge admission to the party.
* Minors cannot transport alcohol
even it is in a closed container. Possession of alcohol by a minor
is a misdemeanor.
* Consumption of alcohol on public
property is illegal. This means that alcohol cannot be consumed on
public streets, parks, or sidewalks. It also includes private
front yards that have public access. ( i.e. not fenced in).
Provide a trash can at the door so guests may dispose of their
cups before they leave. This will prevent them from being arrested
and help eliminate any littering.
* Public urination is against the
law. This is a misdemeanor and requires a court appearance before
a judge, not to mention that it will upset your neighbors.
* Any excessive noise that disturbs
another's peace is against the law. If your party is too loud or
out of control and the police have to respond to break it up, you
may be held responsible for expenses. This includes equipment
used, hourly wages for the officers, and any other expenses
incurred due to the party.
DRUNK DRIVING: How the law works
Of all the fifty states California has the most strict laws
regarding drunk driving. It is a good idea to plan ahead and have
a designated driver.
IF ARRESTED:
1. You will be detained by the
police and taken into custody.
2. Your car will be impounded and
towed away. You have to pay all of the fees.
3. You will be taken to the police
station.
4. You will be asked to take a
blood, breath, or urine test. If you refuse, your license will be suspended for 6 months or more.
IF CONVICTED:
1st Offense:
1. You will pay a fine of $1,063.
2. You will have to attend AA meetings; costing $200+.
3. You will lose your license for a minimum of 90 days.
4. You may be sentence up to one year in jail.
2nd and subsequent Offenses:
1. The fine will increase for each violation, sometimes
doubling the previous fine.
2. Mandatory AA meetings; costs
continue to increase.
3. Your license may be revokes for
3+ years.
4. You will face a mandatory jail
sentence of at least 2 days. Third and subsequent offenses are a
felony and may hold a jail term of 2+ years.
ADDITIONAL PROVISIONS OF THE LAW
If you are in an accident while
driving under the influence and a person is killed, the judge may
sentence you up to 15 years in jail, 1 year suspension of license,
and up to $3,000.00 fine upon conviction.
BREAK THE LAW AND YOU WILL FACE
THE CONSEQUENCES:
A fine for:
* Littering: up to $1,000
* Unlawful operation of a sound
amplifying device: $35 + $65 penalty assessment
* Possession of an open alcohol
container: $50 to $60 + $150 penalty assessment
* Driving under the influence of
alcohol/drugs: $1,063 + alcohol program
A mandatory court appearance for:
* All of the above violations
* Public urination
* Unlawful consumption of
alcohol-minors drinking
* Misrepresentation of age
* Selling alcohol to minors
* Resisting or interfering with a
Police Officer
* Sale or liquor without a license
